The Epic Games on Friday filed a court proposal, in which District Judge Yavon Gonzalez Rogers ordered to order Apple to approve Fortnite for the US App Store, in another growth of the ongoing legal battle between the two companies.
In filing, the epic claims that the Apple is in contempt of the April order of the judge that has banned Apple from rejecting apps on the use of external payment links. Epic argues that by the ruling ninth circuit pending for vengeance for its legal challenges, Apple refused to review its Fortnite submission.
According to a letter by Apple Shared by epicApple said that this “will not take action on the Fortnite app submission after the ninth circuit rules on our pending request for partial migration of the new prohibition.” Epic said that this delay violates Apple’s previous assurance for both Epic and Court that it will approve Fortnite to the app on compliance with Apple’s guidelines.
The dispute has already affected the availability of Fortnight globally. Epic claims that its game disappeared from the European Union App Store on Friday as Apple’s decision to block the US submission. Apple asked EPIC to resume the app without including the US storefront, so that “do not affect Fortnite in other geography.”
There is a need to accept any obedient interpretation app including Fortnite for distribution of Epic court, a contempt decision against Apple, and a requirement of Apple “Apple” App’s store’s store on American storefront. “
The matter rests on whether Judge Gonzalez Rogers will get Apple again in contempt, as he decided on April 30, where he expressed disappointment with Apple’s compliance efforts.
